In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PicCraft provides professional photo editing services including but not limited to:

• Color correction and enhancement
• Retouching and blemish removal
• Background replacement and manipulation
• Photo restoration
• Creative editing and special effects
• Bulk editing services

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you.

3. User Responsibilities

You agree to:

• Provide accurate and complete information when using our services
• Maintain the confidentiality of your account credentials
• Not upload content that infringes on intellectual property rights
• Not use our services for any illegal or unauthorized purpose
• Not upload malicious software or attempt to gain unauthorized access to our systems
• Ensure you have the necessary rights to any images you submit for editing

You are solely responsible for your conduct and any data, text, files, information, images, photos, or other materials that you submit, post, or display on or via the Service.

4. Payment Terms

All services are subject to payment as described on our pricing page. By using our paid services, you agree to our pricing and payment terms as displayed to you at the time of purchase.

• All prices are in US dollars unless otherwise specified
• Payments are processed through secure third-party payment processors
• We reserve the right to change our pricing with 30 days notice to current customers
• Refunds are considered on a case-by-case basis and are not guaranteed
• Chargebacks or payment disputes may result in suspension of services

5. Intellectual Property

You retain all rights to the original photos you submit to PicCraft. By using our services, you grant PicCraft a limited, worldwide, non-exclusive, royalty-free license to use, modify, and display your photos solely for the purpose of providing the requested services.

PicCraft retains all rights to its proprietary software, technology, and any edits, modifications, or enhancements made to your photos as part of our service, except for the original content you provided.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to your submitted images and that they do not infringe any third-party rights.

6. Turnaround Time and Revisions

Turnaround times are estimates and not guarantees. While we strive to meet our stated turnaround times, various factors may affect delivery times.

Revision policies vary by service package:

• Basic Package: Includes 1 revision
• Professional Package: Includes 3 revisions
• Premium Package: Includes unlimited revisions

Additional revisions beyond your package allowance may incur additional fees.

7. Limitation of Liability

To the fullest extent permitted by applicable law, PicCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall PicCraft's aggregate liability exceed the amount you paid PicCraft in the past six months for the services giving rise to the claim.

8. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Hong Kong.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
